These Terms of Service ("Terms") govern your access to and use of Smarter QR Code (the "Service"), operated by Smarter QR Code ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

Smarter QR Code is a conditional QR code routing platform. You create QR codes, configure routing rules, and visitors who scan the codes are redirected based on those rules.

2. Accounts

You must provide accurate account information and keep it current. You are responsible for all activity under your account. You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. One person or legal entity per account.

3. Subscriptions and Billing

Pricing is per QR code. You may create a limited number of free codes; additional codes are billed monthly at the rate shown at signup. Payments are processed by our payment provider. Billing is recurring until you cancel. Cancellation stops future billing; no refunds for partial billing periods unless required by law.

4. Acceptable Use

You agree not to use the Service to:

• Route scans to unlawful, harmful, deceptive, or malicious destinations.
• Distribute malware, phishing pages, or content that violates third-party rights.
• Impersonate any person or entity or misrepresent your affiliation.
• Harass, threaten, or defame others.
• Bypass, probe, or disrupt the Service's security or infrastructure.
• Scrape, resell, or sublicense the Service without our written permission.

We may suspend or terminate accounts that violate these rules, with or without notice.

5. Your Content

You retain ownership of the URLs, labels, styling, and other content you upload. You grant us a limited license to store, process, and serve that content as necessary to operate the Service. You are solely responsible for the pages your QR codes point to.

6. Our Intellectual Property

The Service, including its software, branding, and design, is owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service while your account is in good standing.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may change, suspend, or discontinue any part of the Service at any time, with reasonable notice when practical.

8. Termination

You may cancel your account at any time from the dashboard. We may suspend or terminate your account if you violate these Terms, if required by law, or if continuing to serve your account poses risk to us or other users. After termination, your data may be deleted according to our Privacy Policy.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be error-free, secure, or continuously available.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD $100. We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, or data.

11. Indemnification

You agree to defend and indemnify us against any third-party claims arising from your use of the Service, your content, or your violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. If the changes are material, we'll notify you by email or an in-app notice. Continued use of the Service after changes take effect means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of California, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of California, USA, unless required otherwise by applicable consumer law.
